PUBLIC BIDDING

TERMS AND CONDITIONS:


1. Submission of Application for Eligibility of Bidder and Bid Proposal:
  The bidder shall submit the original bid proposal as indicated in the Invitation to Bid with the accomplished and signed Application for Eligibility of Bidder together with the following documents in sealed envelopes, addressed to The Director, Science Education Institute, PTRI Bldg., Bicutan, Taguig, Metro Manila (Attention: The Officer-in-Charge, General Services Unit), with the bidder's signature across the envelope cover on or before the specified deadline for submission:
 
1.1 Legal Documents:
 
1.1.1. Certificate of Registration with the Department of Trade and Industry (DTI) for sole proprietorship;
1.1.2. Articles of Incorporation or Partnership duly registered with Securities and Exchange Commission (SEC) for partnership and corporation;
1.1.3 Business Permit (Mayor's Permit/Municipal License);
1.1.4. BIR Value Added Tax Registration;
1.1.5. Prospective Bidder's Statement that His Firm is Not Blacklisted or Barred from Bidding by any Government Office/Agency/Corporation
1.1.6. Proof of Bidder's Accreditation with DBM-EPS.
1.2. Technical Documents:
 
1.2.1 Prospective Bidder's Statement of Previous Similar Contracts/Track Record for at least the last two (2) years
1.3. Financial Documents:
 
1.3.1 Audited Financial Statements stamped "Received" by the Bureau of Internal Revenue for the last two (2) Calendar Years
2. Registration of Bidders with DBM-EPS
  All bidders should be registered with the Department of Budget and Management-Electronic Procurement System (DBM-EPS) through www.procurementservice.org
3. Opening, Modification and Withdrawal of Bids:
 
3.1. Only duly authorized representative/s of the company shall participate in the pre-bid conference and public bidding.
3.2. A bidder may modify his earlier submitted bid provided that this is done at least five (5) calendar days before the deadline for the receipt of bids. The modification shall be submitted before the deadline for receipt of bids in a sealed envelope duly identified as a modification of the original bid and stamped received by the Bids and Awards Committee (BAC).
3.3. A bidder shall be allowed to withdraw his bid prior to the time set for its opening provided he communicates his purpose in writing. In this case, the bid shall be returned to him unopened. No bid can be withdrawn for any reason whatsoever after the opening of bids has commenced.

Postponement/Suspension of Opening of Bid Proposals:

 

SEI reserves the right to postpone/suspend the opening of bid proposals upon notice to the participating bidders for any cause whatsoever.

5. Rejection of Proposals:
  SEI reserves the right to reject any or all bids or any part thereof. The following, among others, may be sufficient cause for rejection:
 
5.1. Erasures or corrections in the bidding documents without full signature of the bidder or his duly authorized representative.
5.2. Proposals which are not accompanied by a bid bond or the bid bond is defective or insufficient.
5.3. Proposals submitted after the designated time of opening of bids.
5.4. Proposal forms not properly accomplished by the bidders.
5.5. When statements as to business and technical organization or financial resources have been found to be false and/or fabricated and in the BAC's opinion would justify rejection.
6. Bid Bond Requirement:
  Sealed bid proposals should be accompanied by a bid bond equivalent to at least 2.5% of the total bid price either in the form of cash, manager's check, cashier's check or bidder's bond issued by the Government Service Insurance System (GSIS) callable on demand, valid for 120 calendar days and accompanied by an original official receipt. If bidder's bond is issued by a private bonding company, it should be accompanied with current accreditation from the Insurance Commission. Bid bonds of the bidders considered to be the three (3) lowest calculated and responsive bid shall be retained until after the winning bidder has executed the contract with SEI. Posting of personal checks as bidder's bond will not be accepted.
  Prices quoted are subject to 10% withholding tax.
7. Award of Contract:
  Following the opening of bids, the award of the contract shall be made by the SEI-BAC for the bid most advantageous to the government. Notice to Proceed shall be sent to the winning bidder after the approval of the SEI Director. The acceptance of the award shall bind the winning bidder to accept the award and execute the contract. Likewise, winning bidder should post 10% Performance Bond based on the aggregate amount of the contract.
8. Terms and Conditions of the Contract:
  The specific terms and conditions of the services covered shall be stipulated in the Contract for Services.
9. Duration of the Contract:
  The Contract will become effective on the period specified therein subject to the approval of the SEI Director.
10. Failure to Accept the Award:
  Failure of the winning bidder to accept the award within three (3) days after notice shall be sufficient cause for the cancellation of the award and the forfeiture of the performance bond.
11. Administrative Penalties for Bidders and Prospective Bidders:
  The SEI Director shall impose on bidders or prospective bidders the administrative penalties of suspension from participating in any public bidding of SEI for one (1) year for the first offense and two (2) years for the second offense as well as disqualification from further participating in the public bidding currently being undertaken, where applicable, for the following violations, without prejudice to the imposition of criminal and civil sanctions as provided by laws, rules and regulations stipulated in Section 44 of E.O. 40 :
 
11.1. Submission of eligibility requirements containing false information or falsified documents.
11.2. Submission of bids that contain false information or falsified documents or the concealment of such information in the bids.
11.3. Allowing the use of one's name or using the name of another for purposes of public bidding.
11.4. Withdrawal of a bid or refusal to accept an award or enter into contract with the government without just cause, after it shall have been determined to have submitted the Lowest Calculated and Responsive Bid or the Highest Rated and Responsive Bid, as the case may be.
11.5. Refusal or failure to post the required performance security within the prescribed time.
11.6. Termination of the Contract due to the default of the bidder.
11.7. Any documented unsolicited attempt by a bidder to unduly influence the outcome of the bidding in his favor.
11.8. All other acts that tend to defeat the purpose of the public bidding.
